A Private Guardian ad Litem, or “PGAL”, is a private family law attorney appointed by the court to represent one or more minor children in a divorce or custody case. Once appointed, a PGAL is tasked with determining what is in the best interests of the children they represent. They will conduct an independent investigation, which usually includes:

  • Reviewing relevant records; court records, medical records, school records, DCFS records, police reports, and more.
  • Meeting with their client(s), the minor child or children.
  • Meeting with parents, extended family members, teachers, doctors, therapists, and more.

A PGAL will attend all hearings on behalf of the child/children and, to the extent that is appropriate for their maturity level, keep them updated on the progress of the case. A PGAL will also educate their clients and their parents about the community resources available to them and help them get connected to those resources. Most importantly, a PGAL will make arguments to the court to protect the best interests of the minor child while also keeping the court informed of the child’s wishes. In the midst of high-conflict, emotionally intense, and often chaotic litigation, a PGAL’s role is to be an unbiased advocate for a child and to ensure their voice is heard.
